I N F O R M A T I O N

The undersigned, City Prosecutor I, City of Tagbilaran, Philippines, hereby accuses Tom Cruz and Angelina Jolie for the crime of Estafa under 315, paragraph 1, sub paragraph (b) committed as follows:

            That, sometime in the month of October, 2007 in the city of Tagbilaran, Philippines, and within the jurisdiction of this Honorable Court, the above named accused, conspiring, confederation together and mutually helping one another  being employed as cashier/secretary and officer-in-charge of the KAGANG Transport Equipment Inc. located at CPG Avenue Branch, Tagbilaran City, after having collected the amount of ONE HUNDRED THOUSAND PESOS (P 100,000,00) Philippine Currency, from one Sharon Cuneta as payment of one (1) unit Suzuki Pick up, with plate no. GMP-123, owned by KAGANG Transport Equipment Inc., represented by its accounting department head, Cesar Montano, instead of turning over the aforesaid amount to KAGANG Transport Equipment Inc. The accused, with grave abuse of confidence being the cashier secretary and officer-in-charge thereof, did then and there willfully, unlawfully and feloniously misappropriate, misapply and convert to their own personal use and benefit, and despite repeated demands made upon them  by KAGANG Transport Equipment, Inc., to turn over the ONE HUNDRED THOUSAND PESOS (P 100,000,00) Philippine Currency, the said accused failed and still fails and refuses to remit the said amount, to the damage and prejudice of KAGANG Transport Equipment, Inc., consisting of said amount of money and other damages to be prove during the trial of the case.

            All acts committed contrary to the provision of Article 315. Paragraph 1, sub-paragraph (b) of the Revised Penal Code.

The undersigned has the honor to file the above-entitled case against the respondents Tom Cruise, a known resident of Booy district, Tagbilaran City, and Angelina Jolie, a resident of Bool District, Tagbilaran City, for conspiring, confederating and assisting each other to perform the acts which are criminally actionable as duly delineated in the accompanying affidavits and annexes, committed on same time in January 2007 in the City of Tagbilaran.

It is prayed that after the investigation and if the circumstances warrant, that the corresponding information’s be filed before the proper courts for action and adjudication.

I, MANNY PACQUIOA, Filipino, of legal age, married and a resident of Barangay Langkit, Duero, Bohol. After having been duly sworn to in accordance with the law, hereby depose and say:

1. That I personally know Edgardo Puslik Sr.

2. That last November 22, 2007, I invited Juan Manuel Marques and Edgardo Puslik Sr. to my house for a small birthday party.

3. That on or about 12:00 noon of the same date they arrive together in my house and I invited them to have lunch first.

4. That on the afternoon we were having fun together with my neighbors.

5. That on the evening, Juan Manuel Marques and Edgardo Puslik Sr. is already drunk and I told them not to go home because it’s already dark outside and they are drunk so I offer them to sleep in my house until morning.

6. That I was extremely amazed upon knowing that Edgardo Puslik Sr. had received a subpoena which accuses him of the crime of Parricide of killing his son.

7. That I am executing this affidavit to attest to the truth of the foregoing statement and to support for the dismissal of the case filed against Edgardo Puslik Sr.

1. That I personally know Edgardo Puslik Sr.

2. That last November 22, 2007 is the birthday of our friend Manny Pacquioa.

3. That Edgardo Puslik Sr. and I were invited to the birthday party of Manny Pacquioa in their house in Barangay Langkit.

4. That I went to the house of Manny Pacquioa together with Edgardo Puslik Sr.

5. That on or about 9:30 am of the same date. His son Edgardo Puslik Jr. want to come with us in Barangay Langkit.

6. That Edgardo Puslik Sr. told his son to go home because his younger brother is waiting for him and not to go with us.

7. That Edgardo Puslik Sr. was force to get a stick because his son is still following us and when Edgardo Puslik Jr. saw that his father have a stick on his hand he immediately run home and crying.

8. That the whole afternoon and evening we got drunk and we decided to sleep in the house of Manny Pacquioa.

9. That I was shock upon knowing that Edgardo Puslik Sr. had receive a Subpoena accusing him of the crime of parricide of killing his son.

10. That I am executing this affidavit to attest to the truth of the foregoing statement and to support for the dismissal of the case filed against Edgardo Puslik Sr.

I, EDGARDO PUSLIK SR. Filipino, of legal age, married to Lorena G. Puslik, the father of the said victim, and resident of Guinsularan, Duero, Bohol, after having been duly sworn to in accordance with the law do hereby depose and says:

1.That I am accused for the crime of Parricide, now pending before the Provincial Prosecution Office of Bohol;

2.That I vehemently deny the allegations in the complaint filed against me for being false, fabricated and malicious, the truth being that;

a.That in the morning of November 22, 2007 my friend Juan Manuel Marques and I went to Barangay Langkis. Because we was invited by our friend’s birthday party.
b.That morning of the same date, my son Edgardo Puslik Jr. want to come with us in Barangay Langkis. And
c.That I told my son to go home because his younger brother is waiting for him and I don’t want him to go with us.
d.But instead his not listening to me and I am force to get a stick and when he saw im holding a stick in my hand he immediately run home and crying.
e.That on the whole afternoon until evening of November 22, 2007. were having fun with Juan Manuel Marques and Manny Pacquaio then we got drunk and decided to sleep their until morning.

3.That I was extremely surprised when I received a subpoena

4.That the case filed against me is motivated by bad faith.

5.That I am executing this counter affidavit to attest to the truth of the foregoing statement and to support for the dismissal of the case filed against me.
